Residence Permits
Residence Permit in Latvia for a Sole Trader (IK)
No share capital required. No legal entity to form. A sole trader (Individuālais komersants, or IK) lets a foreign national live in Latvia and run a business under their own name — with full personal liability for any business debts.
Afortis provides legal and administrative assistance: we prepare and file your application. Applications are decided by the Latvian migration authority (OCMA), not by Afortis.
Overview
What is the IK Permit
This Latvia individual merchant residence permit is a distinct path from the SIA company route. Whether it suits your situation depends largely on the scale and structure of your activity.
Who Is It For
Who the Latvia IK Residence Permit Works For
The IK residence permit is a practical option for foreign nationals who:
work independently — freelancers, consultants, IT contractors, designers, or service providers
want to live legally in Latvia and move freely across the Schengen Area
are not ready, or have no reason, to set up an SIA at this stage
It is not well-suited to anyone planning to bring in partners, take on investors, or separate personal assets from business liability. For those cases, the SIA route is usually the right call.
Registering as a Sole Trader in Latvia
Before applying for a latvia individual merchant residence permit, you must register IK status in Latvia. That means:
- entry in the Commercial Register
- selecting the relevant NACE activity codes
- registering with the State Revenue Service (VID) as a taxpayer
IK carries no share capital requirement and is legally equivalent to an individual entrepreneur.
Taxes
A sole trader pays three main taxes:
- Personal income tax (IIN) — calculated on net profit
- Mandatory social insurance contributions (VSAOI) — scaled to income level
- VAT — required once turnover crosses the statutory threshold, or earlier on voluntary registration
One practical note: unlike an SIA, an IK is personally liable for all tax obligations. There is no corporate structure shielding personal assets.
Financial Threshold for Permit Renewal
To renew a temporary residence permit as an IK, the applicant must show:
- total taxes paid of at least €14,300 per year
- evidence of actual commercial activity
- tax and social contribution payments made in Latvia
- reports filed with VID on time
Falling short of the €14,300 threshold is treated as grounds for refusal. In practice, PMLP (Office of Citizenship and Migration Affairs) and VID cross-check the figures closely, so this is not a target to leave until the last quarter.
Business Plan
A latvia self-employed merchant visa application — and each renewal — requires a business plan that:
- describes what the sole trader actually does
- demonstrates that €14,300 in annual taxes is realistically achievable
- shows the financial basis for continued activity
Immigration authorities can and do request an audited or professionally prepared financial justification. Preparing the plan with an accountant from the outset saves considerable back-and-forth later.
